Seller warrants he/she is sole owner, has legal right to sell vehicle and has clear title or consent of lien holder to sell.

MidAmerica Auctions reserves the right to reject a motorcycle not suitable for the auction or with an unreasonable reserve.

Seller understands entry fees are not refundable except when entry is used as a deposit for a no reserve motorcycle.

Seller warrants that information provided about this motorcycle is accurate, with no intent to defraud.

Announcements made on sale day take precedence over earlier printed material. The auction company does not verify and makes no representation as to the description or quality of the item.

Seller agrees to indemnify and hold harmless MidAmerica Auctions for any claim, damage or cost as a result ofmisrepresentation. Seller is responsible for any non-disclosed damages on any vehicle that are not announced.

Seller funds are paid when full payment is received from the buyer, wires may take longer. Seller agrees to MidAmerica Auctions Inc. a seven day check hold policy or a check will be mailed within 10 business days following the auction.

Title and ownership paperwork may be held by the auction company up to 30 days following the auction. If the motorcycle is sold as a result of the auction company's advertising, the auction company is due a commission and buyers fee.

Seller agrees MidAmerica Auctions, Inc. assumes no liability for loss or damage to the vehicle. Seller agrees to save MidAmerica Auctions and employees from any claims from bodily or property injury arising out of auction sale.

MidAmerica Auctions, Inc. is not responsible for the failure of a bidder to consummate the purchase or comply with Terms of Sale. If Seller sues MidAmerica Auctions, but does not obtain judgment, seller shall reimburse MidAmerica Auctions all expenses for defense.

This document is complete and shall be binding upon the parties and heirs.
